General Data Protection Regulation (GDPR)

Data Protection Law in the EEA is governed primarily by the General Data Protection Regulation (EU/2016/679) (“GDPR”).  The GDPR imposes significant compliance obligations on “controllers” such as the GDA. The GDPR is supplemented by national legislation, currently the Data Protection Act(s) 1988 and 2003, and by guidance published by The Data Commissioner.

Privacy Statement 

The protection of your data is important to us as we know how important it is to you.

In most cases the Grangegorman Development Agency, herein referred to as “GDA” is the controller of the data processed as described in this Privacy Statement for the purposes of the General Data Protection Regulation, also referred to as “GDPR”.

This Privacy Statement applies to the processing of personal data by GDA, in its role as controller of personal data under GDPR. This Privacy Statement relates to our approach to privacy.

We may update our Privacy Statement from time to time to reflect any changes in technology, legislation or our data use practices, which may affect the way in which we process your personal information.

 

 Personal Data that we collect and Process 

  • Names and contact details, including home address, phone number and email address;
  • Information that you provide in any online tenders, application forms;
  • Information that you provide in Freedom of Information requests;
  • Information that you submit during a consultation process with us;
  • Information that you submit during the elections to the GDA Board and Consultative Group;
  • Any other personal data relating to you that you provide to us or that we generate about you in connection with carrying out our functions under the GDA Act, 2005.

 

How we use the data we collect

How we collect such information is at all times set out in a clear and plain language, unless and only in circumstances where you contact us for any other purposes not set out in our website. (e.g. general enquiry via email).

We will not use your information to contact you by email, phone or SMS, unless you specifically agree to be contacted and receive such information, project updates and other information as set out in accordance the GDA Act, 2005.

 

Purposes of Processing and Legal Basis

We will use personal data relating to you for the purposes of:

  • improving and developing our website;
  • processing application forms, including for Freedom of Information requests;
  • engaging in a consultation process
  • carrying out research and stakeholder satisfaction surveys;
  • sending you project updates, subject to any preferences that you express when we collect your contact details or subsequently. You can opt out of receiving project updates from us at any time by contacting communications@ggda.ie;
  • generating and analysing statistics regarding usage of this website, including the frequency of use of individual pages (where possible, personal data will be anonymised before being used for this purpose);
  • fraud prevention, investigation and detection;
  • establishing, exercising or defending legal claims; and
  • performing our functions as an Agency and complying with our legal obligations.

The legal bases on which we process your personal data are:

  • that this is necessary for the performance of tasks that we carry out in the public interest or in the exercise of official authority vested in us by law;
  • that this is necessary for compliance with a legal obligation that applies to us; or
  • that you have given your consent to the processing.

 

Recipients of Data

In accordance with our functions, we shall disclose your personal data to other organisations in connection with the above purposes, including:

  • to public service organisations;
  • to third parties who we engage to provide services to us in connection with this website, such as outsourced service providers, IT services providers, professional advisers and auditors;
  • to other public authorities and bodies where required or permitted by law, such as the Gardaí or other law enforcement authorities for the purposes of the prevention, investigation or detection of crime.

With the exception of any personal information which you choose to submit to us via the website on consent of your data and in accordance with GDPR, the GDA does not store any personal information about site users from its website.

Any external links to other websites are clearly identifiable as such and GDA is not responsible for the privacy practices of any external websites and platforms which may be accessed or used in connection with your use of our website.   We would advise that you review the privacy statements of those websites and platforms as they may be subject to different privacy requirements.

Links to Other Sites: Our website has links to many other agencies, and, in a few cases, to private organisations, foreign agencies and international organizations. You should be aware that:

  • If you access another site through a link we provide, you are subject to the privacy policy of that site.
  • Links to other websites do not constitute an endorsement of that website by the Grangegorman Development Agency
  • The Grangegorman Development Agency is not responsible for the contents of any pages referred from its website.
  • We do not provide links to, or promote commercial services that are unconnected to the Grangegorman Development.

Collection and use of technical information

Cookies: This website only uses temporary “session” cookies which enable a visitor’s web browser to remember which pages on this website have already been visited. A cookie is a piece of data stored on the user’s hard drive while they are visiting a particular website. It contains simple information about the user’s identity but no personal information. When the user closes their browser, the cookie is destroyed. You can set your computer not to accept cookies without a loss of functionality on this website.

Log Files: Technical details in connection with visits to this website are logged for statistical purposes. No information is collected that could be used by us to identify website visitors. Our log records do not contain any personal information about users.

 

Your rights

You have the following rights, in certain circumstances and subject to certain restrictions, in relation to your personal data:

  • the right to access your personal data;
  • the right to request the rectification and/or erasure of your personal data;
  • the right to restrict the use of your personal data;
  • the right to object to the processing of your personal data;
  • the right to receive your personal data, which you provided to us, in a structured, commonly used and machine-readable format or to require us to transmit that data to another controller; and
  • where our processing of your personal data is based on you having provided consent, the right to withdraw your consent to the processing at any time by emailing gdpr@ggda.ie

What if I am under 18?

If you are aged 18 or under please ask your parent or guardian for their permission to provide us with your contact information.

 

Retention

We will not hold your personal data for longer than is necessary. We retain your personal data for as long as we need it for the purposes described in this Notice, or to comply with our obligations under applicable law and, if relevant, to deal with any claim or dispute that might arise between you and us. Feedback, queries, complaints and other correspondence submitted on our website or by email. Email addresses of people that subscribe for updates from www.ggda.ie are not kept for an indefinite period in accordance with GDPR. The retention period for Freedom of Information requests, responses and feedback is indefinite.
